Resolution For Moratorium on Approval and Siting of Data Centers

WHEREAS, a "Data Centers" are one or more facilities or an array of connected facilities that house a group of electrical equipment, including but not limited to, networked server computers in one physical location or multiple locations on one or more contiguous parcels of land in order to centralize the processing, storage, management, retrieval, communication, or dissemination of data and information; and

WHEREAS, the Town of New Denmark, Brown County, Wisconsin exercises local zoning authority pursuant to {60.61 Wis. Stats.; and

WHEREAS, the Town has concerns about the potential health and safety issues related to the construction and operation of Data Centers, including environmental impacts, burden on local infrastructure, and the use of and impact on water resources, water use, and electricity demands; and

WHEREAS, the Town of New Denmark has concerns the construction and operation of Data Centers will result in an overburdening of public services and infrastructure, have negative economic impacts, have negative health and safety impacts, and generally affect ambient noise levels and visual impacts within the Town; and

WHEREAS, the Town of New Denmark does not have an ordinance regulating the location, zoning, and operation of Data Centers and the Town believes that such regulation is necessary to protect the health and safety of Town residents, businesses and visitors; and

WHEREAS, Data Centers may not be consistent with the Town comprehensive plan, especially land within the Farmland Preservation Zoning District; and

WHEREAS, the Town of New Denmark acting pursuant to its zoning and other legal authorities believes a one (l) year moratorium on the placing of Data Centers within the Town is necessary to allow for the research and development of appropriate local regulations.

NOWTHEREFORE, The Town Board of the Town of New Demark, Brown County, Wisconsin, by this resolution, adopted by a majority of the Town Board on a roll call vote with a quorum present and voting and proper notice having been given, resolves and orders as follows:

     1. Adopting a one (l) year moratorium on the placing of Data Centers within the Town.

2. Directing the Town Plan Commission together with the Town Zoning Administrator to research and develop appropriate local regulations to the siting, zoning and operation of Data Centers within the Town.
3. Such moratorium may be extended for an additional period of six (6) months following the expiration of the one (1) year if it is in the interests of the Town.

The Town Clerk shall properly post or publish this resolution as required under s. 60.80, Wis. Stats.
